Immigration: Luna Death Provokes more debate on DREAM Act

Immigrant teen's death touches off a charged debate

Joaquin Luna Jr. left a note saying he knew he'd never achieve his life's ambition. Relatives say his example shows why lawmakers must pass the DREAM Act. Some groups cry exploitation.

The night after Thanksgiving, 18-year-old Joaquin Luna Jr. helped his diabetic mother to bed at their home among the Rio Grande Valley orange groves, and whispered beneath the decorative ceilings he had designed in drafting class that he loved her and needed her forgiveness.

As she later told another of her sons, Luna said: "I'm never going to be the person I wanted to be. I'm never going to fulfill my dreams."...

...Rep. Ruben Hinojosa (D-Texas), in a speech to Congress on Thursday, said Luna "took his life because he believed that he would never be able to fulfill his dream of becoming an engineer, earning his citizenship and leading a full and prosperous life in America."...MORE

Congressman Hinojosa spoke today on the floor of the U.S. House of Representatives urging support for the American Dream Act and to honor a Dream Act student who took his own life. Here is his speech in its entirety.
“MR. CHAIRMAN, IT IS WITH GREAT SADNESS THAT I RISE TO URGE MY COLLEAGUES, ON BOTH SIDES OF THE AISLE, TO PASS THE AMERICAN DREAM ACT.

THIS PAST WEEKEND, I LEARNED OF THE TRAGIC DEATH OF JOAQUIN LUNA, A SENIOR AT JUAREZ LINCOLN HIGH SCHOOL IN MISSION, TEXAS WHO TOOK HIS LIFE BECAUSE HE BELIEVED THAT HE WOULD NEVER BE ABLE TO FULFILL HIS DREAM OF BECOMING AN ENGINEER, EARNING HIS CITIZENSHIP, AND LEADING A FULL AND PROSPEROUS LIFE IN AMERICA.

BROUGHT TO THE UNITED STATES AS AN INFANT, JOAQUIN ATTENDED OUR NATION'S PUBLIC SCHOOLS, PLAYED THE GUITAR AT HIS CHURCH, AND HOPED TO GO TO COLLEGE AND ACHIEVE THE AMERICAN DREAM.

I CANNOT EXPRESS THE SORROW I FEEL ON THE LOSS OF SUCH A TALENTED YOUNG MAN. I WANT TO EXTEND MY HEARTFELT CONDOLENCES TO JOAQUIN'S FAMILY AND FRIENDS; I CANNOT IMAGINE THE PAIN THEY ARE SUFFERING. IT IS ESPECIALLY HEARTBREAKING TO KNOW THAT MANY OF US IN THE U.S. HOUSE OF REPRESENTATIVES PASSED THE DREAM ACT AT THIS TIME LAST YEAR, ONLY TO SEE THE LEGISLATION HELD UP IN THE U.S. SENATE BY A VOTE OF 55 TO 41.

TODAY, AS JOAQUIN LUNA'S BODY IS LAID TO REST, I BELIEVE IT'S IMPERATIVE TO UNDERSCORE THE URGENCY OF PASSING THE DREAM ACT IN THE 112TH CONGRESS AND RENEWING HOPE FOR DREAM STUDENTS.

AS A PROUD COSPONSOR OF H.R. 1842, "THE DEVELOPMENT, RELIEF, AND EDUCATION FOR ALIEN MINORS ACT OF 2011" (THE DREAM ACT), I URGE PRESIDENT OBAMA AND MY COLLEAGUES IN THE HOUSE AND THE SENATE TO PUT THEIR IDEOLOGICAL DIFFERENCES ASIDE AND DO WHAT IS RIGHT.

NOW MORE THAN EVER, WE MUST GIVE THESE YOUNG PEOPLE AN OPPORTUNITY TO PURSUE THEIR COLLEGE AND CAREER GOALS, RESOLVE THEIR IMMIGRATION STATUS, AND EARN THEIR CITIZENSHIP.

THE DREAM ACT WOULD ALLOW THESE STUDENTS THE OPPORTUNITY TO EARN LEGAL STATUS IF THEY: WERE 15 YEARS OLD OR YOUNGER WHEN THEY WERE BROUGHT TO AMERICA; ARE LONG-TERM U.S. RESIDENTS AND HAVE LIVED IN THE UNITED STATES FOR AT LEAST FIVE YEARS BEFORE THE ENACTMENT OF THE LAW; HAVE GOOD MORAL CHARACTER; GRADUATE FROM HIGH SCHOOL OR OBTAIN A GED; AND COMPLETE TWO YEARS OF COLLEGE OR MILITARY SERVICE IN GOOD STANDING.

HAVING BEEN BROUGHT BY THEIR PARENTS TO THE UNITED STATES AS CHILDREN, THESE YOUNG MEN AND WOMEN KNOW AMERICA AS THEIR HOME.

WITHOUT QUESTION, DREAM STUDENTS EXEMPLIFY THE BEST OF AMERICAN IDEALS: SUCH AS HARD WORK, PERSEVERANCE, AND THE DESIRE TO CONTRIBUTE TO OUR NATION'S WORKFORCE, ECONOMY AND CIVIC LIFE.

IN THE RÍO GRANDE VALLEY OF DEEP SOUTH TEXAS AND ACROSS THE COUNTRY, DREAM STUDENTS HAVE EXCELLED IN SCHOOL, AND BECOME VALEDICTORIANS, AND ADVANCED PLACEMENT SCHOLARS, AND STUDENT LEADERS, DESPITE FACING DIFFICULT CIRCUMSTANCES.

AS RANKING MEMBER FOR THE SUBCOMMITTEE ON HIGHER EDUCATION AND WORKFORCE TRAINING, I HAVE NO DOUBT THAT DREAM STUDENTS CAN HELP AMERICA ACHIEVE PRESIDENT OBAMA'S AMBITIOUS HIGH SCHOOL AND COLLEGE COMPLETION GOALS BY THE YEAR 2020.
MANY OF THESE STUDENTS ARE WORKING TIRELESSLY TO EARN THEIR HIGH SCHOOL AND COLLEGE DIPLOMAS AND ASPIRE TO BECOME PROFESSIONALS IN THE SECTORS OF OUR WORKFORCE WHICH NEED THEIR TALENT, SKILLS, AND INGENUITY.
IN THE AREAS OF SCIENCE, TECHNOLOGY, ENGINEERING, AND MATHEMATICS (STEM), FOR EXAMPLE, OUR COUNTRY MUST TRAIN A NEW GENERATION OF HIGH-SKILLED SCIENTISTS, ENGINEERS, AND MATHEMATICIANS -- TO BOLSTER SCIENTIFIC DISCOVERY AND SPUR TECHNOLOGICAL INNOVATION. SIMPLY STATED, THESE TALENTED YOUTH CAN HELP OUR NATION INCREASE ITS GLOBAL COMPETITIVENESS AND BE THE INNOVATORS OF TOMORROW.

FINALLY, IT'S IMPORTANT TO NOTE THAT THE DREAM ACT HAS ENJOYED BROAD, BIPARTISAN SUPPORT FROM MEMBERS OF CONGRESS AND ADMINISTRATION OFFICIALS ON BOTH SIDES OF THE AISLE. THEY INCLUDE SECRETARY OF EDUCATION ARNE DUNCAN, FORMER SECRETARY OF DEFENSE ROBERT GATES, FORMER SECRETARY OF STATE COLIN POWELL, AND CARLOS GUTIERREZ, FORMER SECRETARY OF COMMERCE UNDER PRESIDENT BUSH.

CHANCELLORS AND UNIVERSITY PRESIDENTS AND THOUSANDS OF STUDENTS, CIVIL RIGHTS GROUPS, AND PROMINENT EDUCATION, BUSINESS, RELIGIOUS LEADERS, AND ELECTED OFFICIALS SUPPORT THE DREAM ACT BECAUSE IT IS HUMANE AND SENSIBLE. IT'S THE RIGHT THING TO DO!

I ESPECIALLY WANT TO THANK REPRESENTATIVE HOWARD BERMAN AND REP. LUCILLE ROYBAL-ALLARD (ORIGINAL SPONSOR) AND SENATOR RICHARD DURBIN FOR THEIR EXTRAORDINARY LEADERSHIP ON THIS ISSUE.

IN CLOSING, I URGE MY COLLEAGUES ON BOTH SIDES OF THE AISLE TO JOIN ME IN HONORING THE LIFE OF JOAQUIN LUNA BY COSPONSORING H.R. 1842, "THE DREAM ACT" AND GIVING THESE DESERVING STUDENTS THE OPPORTUNITY TO MAKE MEANINGFUL CONTRIBUTIONS AS A PART OF OUR NATION'S WORKFORCE, IMPROVING THE QUALITY OF LIFE OF ALL AMERICANS.” link

DREAM Act Supporters: Democrats Shouldn't Count On Us In 2012

WASHINGTON -- Six months after the Senate voted down a bill to provide legal status to some undocumented students, DREAM Act supporters are mobilizing for 2012, hoping to hold Democrats accountable for failing to pass the bill last year...

-----------------------------------

Its true -- how can DREAMer supporters think of supporting Obama or any other Democrats in 2012?  The bill has been paraded and quickly dropped so many times.... it is clear its just a game the Democrats are playing to get more Latino votes...MTHdz

For DREAMers - After the Vote - Taking Care and Regenerating

from Kyle de B. at Citizen Orange:

....For the many of you that just don't have the means at your disposal to get back to a healthy place please do the hard thing and reach out to other people in the movement and ask for help.  I say that knowing how hard it is to reach out, especially when you're not in the right place, but I can also tell you how amazing it feels when you do reach out and find out there are people in this movement who will be there for you.  I have to specifically mention, here, anyone who's allowing thoughts of suicide to enter their minds.  I don't think there are adequate words for anyone in that situation.  All I can do is plead with all of my heart that you reach out and feel just how valued you are to others in this world and to God.  I also ask everyone in this movement to be vigilant and make sure those around you are doing well. For anyone that wants to reach out to me, I'm always an email away.

The second thing I wanted to say to everyone is that in times like this,
when the ephemeral world fails you time and time again, the best thing you can do is draw strength from something ethereal, by which I mean heavenly or celestial.  For the vast majority of us I think that means drawing strength from friends and family, people who will be there for you no matter what and who mean something to you far beyond any Senate vote.  But what I really mean is the way I've learned to stay committed to making change in this world is by drawing strength from religion, and my commitment to God.  That means something very specific in my faith, but in the many spokes that make up the wheel of Truth, it can mean any number of things.  Even a dispassionate student of history will show, I think, that the only sustainable revolutions are those that draw from faith.  Don't believe me?  Read historian Eric Hobsbawm and his analysis of millenarian movements in Primitive Rebels.

Finally, and most importantly in the context of this post, after you've done the first two things,
get back into the fight.  Flavia over at dreamactivist.org said it first and probably said it better: "There are battles everywhere, over access to education, in-state tuition, financial aid, driver's licenses... the list goes on. We have only just begun."  I might even steal her Oscar Romero quote at the end of this post, too.  He says it better than almost anyone.  My only tiny qualm with Flavia's post is that she says "If you feel like giving up, you are entitled to do so."  It depends on what "giving up" means, but I don't think anyone is entitled "give up," generally.  By all means, take care of your body, mind, and spirit before you start going around trying to save the rest of the world.  If you're not in the right place physically, mentally, or spiritually, taking a break to get on the right track is not optional, it's necessary.  You can't clean the world with dirty hands...link to complete Citizen Orange post

Don't Write the Obituaries for the DREAM Act

A few days ago I watched a video regarding the current Congressional session on Politico.  The interviewee was so negative about the DREAM Act, perhaps that's his job... maybe he was thinking he had to be serious... but what he came across was negative - and almost glad the DREAM Act might be going under....

The DREAM Act is not dead.  If it was, it would not have re-surfaced so many times the past seven years....

Dream Act may come back to haunt the GOP

From Hamlet:  "I am thy father's spirit"

As Latino voters' clout grows, Republicans could come to regret their shift against the Dream Act, designed to give young illegal immigrants a path to citizenship.

  • By Kathleen Hennessey, Washington Bureau

After years of courting Latino voters with a softer tone on immigration, Republican leaders in Congress have all but abandoned that posture, risking what remains of GOP support among the fastest-growing segment of the U.S. population.

The latest example is the near-unanimous opposition by Senate Republicans to the Dream Act, a measure that provides a way for some illegal immigrants who arrived in the U.S. as children to become citizens.

The bill once was seen as a bipartisan initiative that offered the GOP a bridge to Latino voters. But in a Senate debate last week, Republicans branded the measure as "amnesty," denouncing it as ripe for abuse.

The party's once solicitous outreach to Latino voters has been all but drowned out by a powerful grass-roots movement incensed over illegal immigration. GOP lawmakers are increasingly fearful of incurring the movement's wrath.

Republicans logged victories in last month's midterm election, relying on support from their core voters and disaffected independents. But the GOP approach to immigration may come back to haunt the party..

Future of the DREAM Act

MIAMI (AP) — The illegal immigrants who more than a decade ago were just teens hoping to forge a legal path to citizenship are vowing to make the Dream Act a campaign issue come 2012, even though they'll likely be too old to benefit if the law ever passes.

The measure that passed in the House on Wednesday is unlikely go anywhere in the Senate, and the House is unlikely to revisit the issue once the new Republican leadership takes over...link

DREAMers Undettered As Senate Delays Action on DREAM Act
Path to Legal Status for Undocumented Youth to be Voted on Next Week

CONTACT: Jose Luis Marantes, joseluis@unitedwedream.org, 407-520-8714

Statement from the United We Dream Network:

“As young undocumented people, along with our American citizen supporters, we await another round of debate next week as Congress will vote on the DREAM Act, a measure to create a path to legal status for those who attend college or serve in the military. The Senate voted to table their version of the DREAM Act, as they await to debate the version that just passed the House of Representatives yesterday.

DREAM Act students will not rest and will continue advocating until the very end of the lameduck session. Affiliates of the network held watch parties across the nation for Dreamers to support each other and call their Senators together.

The DREAM Act must now gather critical support from a number of Senators still sitting on the fence, both Democrats and Republicans. Having more time between votes gives us time to shift our focus from the House to the Senate and make sure our voices are heard.

Some republicans have blurred the debate by painting a negative portrayal of undocumented students. Senator Sessions took to the Senate to claim that DREAM-eligible people would buy fake diplomas online. Our lives are real and our diplomas are real. We need Senators to rise above the fakeness and get real, the time for DREAM is now. We urge everybody who has ever supported the DREAM Act to take time to make some phone calls and urge senators to vote YES on DREAM. As Representative John Lewis shared last night, “The time is always right to do what is right”.

The United We Dream Network is a national immigrant youth-led organization committed to achieve equal access to higher education for all people, regardless of immigration status. We aim to address the inequities and obstacles faced by immigrant youth and to develop a sustainable, grassroots movement, led by immigrant youth, documented and undocumented, and children of immigrants. DREAM act appears dead after Dems pull it from consideration

STORY HIGHLIGHTS
  • The bill would offer a path to citizenship for some illegal immigrants
  • It mainly would affect illegal immigrants who entered the U.S. as children
(CNN) -- Senate Democrats conceded Thursday they don't have the votes to pass the DREAM Act, a bill that would have offered a path to citizenship for some illegal immigrants who entered the United States as children.
Democrats voted to pull the measure from consideration on Thursday. That likely kills any chance of passage this year for the hotly contested bill, Senate supporters say.
Senate Republicans opposed the bill, standing by their pledge to block any legislation during the lame duck session until the chamber approves bills to extend the Bush tax cuts and fund the government...link

CNN:  House approves DREAM Act, but Senate approval uncertain

By the CNN Wire Staff
December 8, 2010 9:10 p.m. EST

Washington (CNN) -- A hotly debated measure that offers a path to citizenship for illegal immigrants who came to the United States as children won approval Wednesday from the U.S. House.

The 216-198 vote, mostly on partisan lines, sends the so-called DREAM Act to the Senate, where it was uncertain if supporters had the votes to overcome a certain Republican filibuster against it.

The Development, Relief and Education for Alien Minors Act -- or DREAM -- would create a path to citizenship for immigrants who entered the United States illegally as children under the age of 16 and have lived in America for at least five years, obtained a high school or General Education Development diploma and demonstrated "good moral character," according to a White House fact sheet...link to complete CNN article

DREAM Act Passes the House

9:11 PM ET, 12/ 8/2010
Excellent news! The DREAM Act - supported by our military, estimated to "contribute at least one trillion dollars to the American economy" over the lifetimes of students covered by the Act - just passed the House of Representatives by a vote of 216-198. The overwhelming majority of Democrats voted "aye," while nearly every Republican voted "nay." I guess Republicans would prefer to cede the Hispanic vote for a generation or two. Fine with me! :)

Also, I'll be very interested to see how the Virginia delegation voted.  I presume all the Republicans voted "nay," but what about the Democrats - Boucher, Connolly, Moran, Nye, Perriello and Scott? We'll find out shortly.

Anyway, now it's on to the Senate, where so much good legislation goes to die. Hopefully, this bill won't fall into that category...
